The regional network of organisations that make up the information system SInViolencia LGBTI joins the call of rejection of the Rainbow Justice campaign against the decision of the Executive Council of the Judiciary of Peru, issued in its Resolution No. 002-2020-CE-PJ. This resolution approves the adherence to the update of the \"100 Brasilia Rules on Access to Justice for Persons in Conditions of Vulnerability\", with the exception of Rule No. 4, which establishes sexual orientation and gender identity as a \"cause of vulnerability\", denying both categories as factors of vulnerability and discrimination.<\/p>\n
The decision is based on the assessment of sexual orientation as an \"abnormal\" condition motivated by psychological and social factors, which constitutes a serious setback in terms of access to justice for the LGBT population in Peru and the recognition of LGBT rights in the region. Since 2014, SInViolencia LGBTI has recorded the murder of more than 3,050 lesbian, gay, bisexual and transgender people, whose cases, like that of Azul Rojas Mar\u00edn, have seen the criminal justice systems of more than ten countries in the region systematically fail to clarify, investigate and punish these acts.<\/p>\n
Violence and impunity are two of the highest costs of discrimination against LGBTI people. Denying sexual orientation and gender identity as factors of vulnerability, discrimination and exclusion is detrimental not only to the rights of LGBTI people, but to all people in vulnerable conditions in our democratic systems.<\/p>\n
In this way, we join the call to reconsider this resolution and support the request made by the Permanent Commission on Access to Justice for Vulnerable Persons.<\/p>\n
