Marriage and the UMH are the two concepts that exist in Colombian law through which the character of a family is recognised for a couple that would otherwise have no ties with each other. Marriage is formed from the celebration of a contract by which two people agree to unite their lives, while the UMH is built from cohabitation and the will to have a community of life expressed in everyday life.<\/span><\/p>\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n

Differences<\/b><\/p>\n<\/td>\n<\/tr>\n

<\/td>\nMarriage<\/b><\/td>\nUnincorporated Marital Union (UMH)<\/b><\/td>\n<\/tr>\n
Start<\/span><\/td>\nFrom the signing of the marriage contract.<\/span><\/td>\nFrom the first day of living together.<\/span><\/td>\n<\/tr>\n
To whom it is made<\/span><\/td>\nMunicipal civil court, notary's office, or religious authority. In other words, it can be civil or religious.<\/span><\/td>\nNotary, Conciliation Centre or Family Court of the Circuit. It can only be civil.<\/span><\/td>\n<\/tr>\n
Name given to its members<\/span><\/td>\nSpouses, husbands or wives.<\/span><\/td>\nPartners, partners or permanent partners.<\/span><\/td>\n<\/tr>\n
Means of proof<\/span><\/td>\nWith the civil registration of marriage.<\/span><\/td>\nBy public deed, deed of conciliation or court judgement.<\/span><\/p>\n

In the case of a judgement, the process can prove cohabitation with witnesses, documents or whatever is necessary to prove cohabitation.\u00a0<\/span><\/p>\n

In the case of health and pensions it can be proved by testimonies or extrajudicial statements.<\/span><\/td>\n<\/tr>\n

Patrimonial effects<\/span><\/td>\nFrom the moment of the celebration of the marriage.<\/span><\/td>\nThey are presumed after 2 years of cohabitation.<\/span><\/td>\n<\/tr>\n
Capitulations<\/span><\/p>\n

(This is an agreement in which the couple establishes which assets are part of the property partnership or the applicable property regime).<\/span><\/td>\n

Marriage contracts can only be made before marriage.<\/span><\/td>\nMarital contracts can be made before the start of cohabitation and up to 2 years of cohabitation.<\/span><\/td>\n<\/tr>\n
International recognition<\/span><\/td>\nIn general, marriage is recognised abroad.<\/span><\/td>\nIt is limited to Colombia and its recognition abroad depends on its resemblance to some form of Colombian law.<\/span><\/td>\n<\/tr>\n
Prevalence<\/span><\/td>\nMarriage takes precedence over UMH. Where a previous union exists, marriage terminates it.<\/span><\/td>\nThe UMH cannot exist simultaneously with the marriage. A property partnership cannot exist between permanent partners if the marital partnership has not been liquidated.<\/span><\/td>\n<\/tr>\n
Legal action<\/span><\/td>\nActions for divorce or separation of property (liquidation of the marital partnership) can be initiated at any time, even if the couple is no longer living together.<\/span><\/td>\nThere is a period of 1 year from the physical and definitive separation of the partners, from the marriage with third parties or from the death of one or both partners to take action related to the separation of assets (liquidation of the patrimonial partnership).<\/span><\/td>\n<\/tr>\n
Note:<\/b> In relation to the quality of beneficiaries of health, pension, the possibility of inheriting or opting for the marital portion, spouses, permanent partners enjoy equal legal protection.\u00a0<\/span><\/p>\n
