Consultancy for the National Plan on preventive security and integral protection of LGBTI human rights defenders with emphasis on Trans and Intersex people.
- BACKGROUND
 
The project "Adelante con la Diversidad II: Fuerzas sociales, políticas y jurídicas para la protección efectiva de los derechos del colectivo LGBTI y sus defensores en la Región Andina" has as its general objective: to guarantee comprehensive security, access to justice and the right to non-discrimination of LGBTI human rights defenders in Bolivia, Colombia, Ecuador and Peru.
Within the framework of the activities of this project, Colombia Diversa (Colombia), with funding from the European Union, is developing activities to strengthen preventive security and comprehensive protection of LGBTI human rights defenders and organisations, especially trans and intersex people.
For this reason, the aim is to build a National Integral Security Plan as a tool for LGBTI organisations in Colombia.
2. OBJECT
Build a National Comprehensive Security Plan for LGBTI human rights defenders, with an emphasis on Trans and Intersex people in coordination with the project's implementing actors as established in the TOR for this consultancy.
3. ACTIVITIES AND OUTPUT
- Activities:
 
- A timetable and work plan should be drawn up with the activities and products to be carried out in the consultancy.
 - A diagnosis of the needs and difficulties of LGBT human rights organisations in Colombia must be carried out. This diagnosis can be carried out using different qualitative methodologies that bring together the experiences of national and local organisations, for which it will be necessary to travel to different regions of the country, according to prioritisation criteria previously established between the consultants and Colombia Diversa.
In addition, it should be developed under the axes of prevention, protection and guarantees of non-repetition, and security should be understood in a comprehensive manner, taking into account the physical, digital and psycho-emotional aspects. - A mapping of protection routes for defenders in Colombia should be carried out. These routes should have a comprehensive approach, i.e. the state's offer of physical, digital and psycho-emotional protection should be mapped. In addition, it should include those routes or policies with a gender focus and/or that have been carried out with women's organisations in Colombia.
 - Carry out a Security Advocacy Plan for LGBT defenders. This product will aim to generate guarantees for the protection of the life and integrity of LGBT people in the free and safe exercise of their social and political leadership and their right to defend human rights, incorporating comprehensive proposals for prevention, care, protection and guarantees of non-repetition.
 - Make recommendations to overcome the barriers to access to justice in integral protection in Colombia. This product should include a diagnosis of the main difficulties in access to justice in matters of integral protection, as well as ways to mitigate these main difficulties, including difficulties in the collection of evidence. In addition, a guide should be prepared that explains in detail how to activate the existing routes, as well as models of the tools and/or legal actions necessary to activate them and/or demand their fulfilment.
 - Delivery of the final document compiling the above products.
 
Products:
The products to be delivered shall be made in accordance with the relevant characteristics of the previous point. The products shall be as follows:
- Work schedule.
 - Diagnosis of the needs and difficulties of LGBT human rights defenders' organisations in protection in Colombia.
 - Protection Route Mapping.
 - Security Incident Plan.
 - Recommendations for overcoming barriers to access to justice in comprehensive protection in Colombia.
 - National Security Plan compiling the above products.
 
REQUIREMENTS
The application must be carried out by a pair of experts (natural persons) each with the following conditions

Mandatory requirements
- Undergraduate or graduate degree in social sciences, arts, law and related subjects
 - 4 years of demonstrable experience in LGBT rights-related issues
 - 2 years of experience in human rights issues in Colombia
 - Proven experience of working with LGBT organisations
 
Desirable
- Postgraduate studies in Human Rights, Gender Studies and related subjects
 - Expertx on the protection of human rights defenders in Colombia
 
Mandatory requirements
- Undergraduate or graduate degree in social sciences, law and related subjects
 - 4 years of experience in human rights protection issues
 - Verifiable experience of working with human rights organisations in Colombia
 
Desirable
- Experience working on gender issues
 - Postgraduate studies in Human Rights, Gender Studies and related subjects
 
EXECUTION TIME
4 months (May, June, July and August)
PAYMENT
The Contract will have a value of EUR 5,000.
(a) Variation of the value. The value may vary according to the exchange rate between Colombian pesos and the foreign currency on the day the payment is negotiated each month. It may also vary due to the rates generated between Colombian pesos and the currency of the bank account where the payment will be received. Colombia Diversa will not assume positive or negative differences caused by exchange rates.
(b) Funds in Colombia. Some of the funds are monetised in Colombian pesos.
(c) Taxes and Withholding Taxes. Likewise, please note that according to the Colombian Legislation the values may be encumbered by fees, taxes or additional obligations. Withholding taxes for payments abroad to foreigners are twenty percent (20%) or as established by the Colombian Legislation in force. The value of the 20% withholding is not applicable to non-profit organisations (proven in tax documents of their country of origin). If you are a resident in Colombia, you must pay social security and submit tax returns with each collection account of the contract.
(d) Bank Fees for International Transfers. Colombia Diversa will not assume the costs for international transfers and they will be charged to the monthly amount.
To be paid as follows:
- 50% with the Chronogram, work plan and compliance policy, with the Diagnosis and Mapping of protection routes for defenders in Colombia.
 - 50 % with the Recommendations for overcoming barriers to access to justice and with the delivery of the outcome document
 
The contract is NOT exempt from the application of taxes, withholdings and duties, which depend on the tax regime of the consultant. In the case of natural persons, the corresponding social security payments will be requested.

Resumes of the two persons of the team that will implement the project.
Registro Único Tributario (RUT) or tax document of the (natural) person who would sign the contract, indicating the tax regime to which the person belongs.
Passport and/or citizenship card or national identity card of the persons making up the consultancy team.
Demonstrable experience in the fields requested. For this purpose, please indicate in your CV any references and/or certificates of experience.
It should be established who leads the working group and a collective document from those linked persons acknowledging that leadership. This is for purposes of communication, leadership and to eventually establish the negotiation among other elements.
PROPOSAL
The proposal must contain the following
Proposed timetable
Methodology to be used for each product (should include the proposed number of visits to different regions of the country).
A proposal of activities per product (additional to those outlined in these terms of reference).
EVALUATION
An Evaluation Committee will be formed with members of the organisation.
INTELLECTUAL PROPERTY
Intellectual property rights and other proprietary rights, including without limitation patents, copyrights and trademarks in respect of products or documents and other materials directly related to or produced, prepared or obtained as a result of or in the course of this consultancy are owned by Fundación Hivos and Colombia Diversa.
In case of publication, the document resulting from this consultancy will be Creative Commons for free use and reproduction without alteration of the original work.
CONFIDENTIALITY
The contracted consultants undertake to keep confidential the content of all information and documentation to which they have access, keeping it private, which cannot be extracted from the institution, much less disclosed in whole or in part and at the end of the work. Likewise, the final files must be delivered in digital format with all the annexes, tools and other documents relevant to the study.
