2022: Not a step backwards in defending the rights of LGBTIQ+ persons

In 2022 Colombia Diversa continued to strengthen its work team to transform cultural imaginaries that limit the dignified life of LGBTIQ+ people, access to full rights for LGBTIQ+ people and the construction of an inclusive and lasting peace.

Thanks to the advocacy work of Colombia Diversa and several feminist and LGBTIQ+ organisations, several milestones were achieved that we have been waiting for for years and that we hope will come to fruition:

  • The Ministry of Health and Social Protection and the National Institute of Health must eliminate discrimination against men who have sex with men and transgender people as risk factors, groups, populations or behaviours in the guidelines on blood donation (Sentencia T-171/22).
  • The Colombian Institute for Family Welfare (ICBF) must refrain from subjecting same sex parent families to unjustified delays and unnecessary administrative procedures (Judgment T-311/22).
  • The Special Justice for Peace (SJP) announced that it will prioritise the investigation of "sexual violence and other crimes motivated by the gender, sex, orientation or gender identity of the victims during the armed conflict" (Macro-case 11). However, to date, the SJP's Recognition Chamber has not opened a macro-case investigating these crimes. The persistence of institutional obstacles to the investigation of these crimes constitutes an act of discrimination against women and LGBTQ persons because it has prevented them from accessing justice. In the full version of the statement we develop six (6) arguments why the JEP has the capacity to open macro-case 11. Therefore, from the Five Keys Alliance we make a public call for the JEP to guarantee access to justice for women, girls and LGBTQ people.
